Jazmine Phillips’ family appeared in court on Wednesday (February 21), claiming she did not want to become an organ donor.

“God performed a miracle today,” said a family member. “She’s ours. She’s not for the nation, but I’m overjoyed.”
According to the family’s attorney, Phillips went to the hospital on February 14 complaining of a headache.
“After 16 hours, we found that her brain was too swollen and inactive,” attorney Michael Oakes said. “That was her wish, that her organs not be taken away.”
Oakes said Phillips had expressed to many people his desire not to donate his organs. But Gift of Life Michigan takes a different view.
“While her driver’s license was completed on her own will and voluntarily and submitted to the Secretary of State, it is not a document submitted to Gift of Life. “It’s objective evidence that he intended it,” Jill Erickson said.
Her family said Phillips planned to change her donor status when her license expires in 2026.
Michigan Gift of Life said it respects the court’s decision and that its hearts sympathize with Phillips’ family and expresses its deepest sympathies for their loss.
The girlfriend of Phillips’ relative was a key factor in the judge’s decision.
She testified that on the way to the hospital, Phillips told her he wanted to keep her organs.
The judge cited her legal distance from Phillips to give more weight to her statement.
